Defendants, administrators of the Kentucky welfare and unemployment insurance programs, appeal from an award of attorney's fees in three cases arising from the United States District Court for the Western District of Kentucky. Plaintiffs have cross-appealed in two of the cases from the district court's denial of attorney's fees for legal services performed in pursuit of fees. These appeals present three basic issues: whether the district court properly relied upon the Civil Rights Attorney's Fees Awards Act of 1976*fn1 (hereinafter Act) as a basis for awarding attorney's fees; whether the district court properly exercised its discretion in computing and awarding the fees; and whether attorney's fees may be awarded for legal services performed in pursuit of attorney's fees. For the reasons stated below, we affirm in part, reverse in part, and remand with directions.
