The opinion of the court was delivered by This is an appeal from the district court in which the district court sustained in part and reversed in part a decision by a Department of Human Resources hearing officer and approved by the Secretary of Human Resources. In sustaining the [234 Kan. 1017] hearing officer's decision, the court held the employee was entitled to the payment of the disputed wages. In reversing the hearing officer, the court held the employee was not entitled to statutory penalties for the employer's failure to pay the disputed wages. The court also held the employee was not entitled to prejudgment interest. Both parties appeal.
